Statement from Acting City Clerk Nadine Nader

As the Elections Official for the City of Santa Clara, my role is to ensure that election activities comply with federal, state and local law. I am issuing this statement because the legal role and actions taken by the City Clerk’s Office staff have been incorrectly characterized by a statement made by the Campaign of Anthony Becker. The election role of the City Clerk includes receiving final campaign disclosure documents from candidates and validating that they are completed within the prescribed California Fair Political Practices Commission and City timeframes, and in accordance with our local Political Campaign Finance Reform Act. The role of the City Clerk is not to render or provide legal opinions, nor is it to provide advice on how to fill out campaign disclosure forms. This is the role of a candidate’s attorney or campaign staff. 

The City Clerk’s Office did not receive a phone call from the Campaign of Anthony Becker requesting information or guidance on receiving a $1,000 contribution. Nor, did we advise anyone on how to fill out campaign disclosure forms, which would exceed the role of the Elections Official.  Consequently, the City Clerk’s Office has received an amended Form 497: 24-Hour Contribution Report, which corrects the contribution amount from the Santa Clara Chamber of Commerce PAC from $1000 to $590, which is now in compliance with the City’s established campaign contribution limit.
