Park and Recreational Land Dedication and new Residential Development Impact

Background

Since September 13, 2014, the Santa Clara City Code includes Chapter 17.35 “Park and Recreational Land” that requires new residential developments to provide developed park and recreational land and/or pay a fee in-lieu of parkland dedication pursuant to the California laws known as the Quimby Act (Quimby) and/or Mitigation Fee Act (MFA).  A financial credit of 50% against the fees due in lieu of dedicating neighborhood and community parks may be provided for eligible private, on-site active recreational amenities. In addition, the City has an existing Chapter 3.15 Dwelling Unit Tax. The land valuation and City Fee Schedule are updated on an annual basis through the City Budget review and approval process.
