Architectural Review Procedures
 
An Architectural Review process has been initiated by the City Council of the City of Santa Clara in order to encourage the orderly and harmonious appearance of structures and properties; maintain the public health, safety and welfare; maintain property and improvement values throughout the City and encourage physical development of the City as intended by the General Plan. Architectural Review is the responsibility of the Architectural Committee or Director of Planning and Inspection, as designated.
 
Application shall be made for Architectural Review prior to a building permit being issued for any sign, building, structure or exterior alteration of a structure in any zoning district in the City.
 
The amount of the nonrefundable filing fee is shown in the Planning Division's Schedule of Fees. Non-freestanding signs, landscaping and single family residential projects are excluded from this fee. Application is made at the Permit Center in City Hall, 1500 Warburton Avenue. An application form, fee and five copies of fully dimensioned plot plans and elevations should accompany the application. Detailed instructions are provided on the back of the application.
 
When an application for architectural review is received in the Planning Division Office, it is date stamped, receipted and listed in the Architectural Review log. New files are also noted on the correct parcel in the assessor's book, on the Architectural Review map and Tidemark permit software.

Minor exterior changes, small additions that are compatible with the existing building, landscaping and signs conforming to a master sign program can be approved at the staff level. Applications requiring Committee review should be submitted at least two weeks prior to the Committee meeting. The Committee currently meets twice a month.

In order to grant architectural approval, the findings and determinations of the Architectural Committee must be that the design and location of the proposed development is such that it is in keeping with the character of the neighborhood and will not be detrimental to harmonious development as specified by the Zoning Ordinance and the General Plan of the City. Major projects, such as an industrial complex with more than 100,000 square feet of floor area, may be referred to the Project Clearance Committee for an environmental determination and development of required conditions, particularly relative to traffic mitigation.

A set of more detailed policies and guidelines for Architectural Review are maintained in the Planning Division Office. With City Council approval, the criteria and policies shall be updated from time to time as is necessary.

If the Architectural Committee is unable to make the findings and determinations necessary for architectural approval, the application shall be denied. The Architectural Committee renders a decision on any application for architectural approval within 40 days of the filing of the application with the Planning Division, except where the applicant consents to an extension of time. Failure of the Architectural Committee to render a decision within this time (and any period of extension consented to by the applicant) is deemed to be a decision of denial.

In the event an applicant is not satisfied with the decision of the Architectural Review Committee, it may be appealed (PDF) within 7 days after such decision in writing to the Planning Commission and after payment of an appeal (PDF) fee. The Planning Commission actions are appealable to the City Council in accordance with the procedures set forth in Section 54-6 of the Zoning Ordinance.

Any Architectural Review approval granted in accord with the City's adopted ordinances is automatically revoked and terminated if construction has not begun within two years of the original approval, unless an extension of time is authorized by the Director of Planning and Inspection.
